Articles of Agreement

Articles of Agreement indented made and concluded upon this eighteenth day of September one thousand eight hundred and forty one Between John Wright Clover of Aylsham in the county of Norfolk gentleman of the first part Joseph Thomas Clover son of the said John Wright Clover of the second part and Charles Mends Gibson of the city of Norwich Surgeon and Apothecary of the third part.

Whereas it hath been agreed between the said John Wright Clover and Charles Mends Gibson that he the said Charles Mends Gibson should for the consideration hereinafter mentioned takes the said Joseph Thomas Clover as his pupil or apprentice for the term of Five years and during all the said term should employ the said Joseph Thomas Clover in the said profession or Business of a Surgeon and Apothecary

Now these Articles Witness that in consideration of the sum of two hundred and forty pounds sterling to be paid to the said Charles Mends Gibson by the said John Wright Clover in manner following, that is to say the sum, of Eighty pounds part thereof on the execution of these presents the sum of Eighty pounds further part thereof on the eighteenth day of September which will be in the year one thousand eight hundred and forty two and the sum of eighty pounds residue thereof on the eighteenth day of September then next following and which will be in the year One thousand eight hundred and forty three, the receipt and payment of which said first instalment of Eighty pounds he the said Charles Mends Gibson doth hereby acknowledge, He the said Charles Mends Gibson doth hereby for himself his Heirs Executors and Administrators covenant promise and agree to and with the said John Wright Clover his Executors and administrators that he the said Charles Mends Gibson shall and will take the said Joseph Thomas Clover as his pupil or apprentice for the term of Five years to commence and be completed from the day of the date of these presents and fully to be completed and ended

And during the said term shall and will employ and to the best of his skill and ability teach and instruct, or cause to be taught and instructed, his said pupil or apprentice in the art science profession or business of a Surgeon Manmidwife and Apothecary

And also shall and will, in case the said Charles Mends Gibson shall during the said term be appointed Surgeon or Assistant Surgeon to the Norfolk and Norwich Hospital or to any Dispensary or any other Institution of a like nature, permit and suffer the said Joseph Thomas Clover to attend such Institution as his pupil or Apprentice for the residue of the said term which shall be unexpired at the time of such appointment without any additional fee or consideration

And also that he the said Charles Mends Gibson shall and will during the said term until the eighteenth day of September which will be in the year One thousand eight hundred and forty four fund and provide the said pupil or apprentice with comfortable and convenient lodging in the Dwellinghouse of the said Charles Mends Gibson and with sufficient meat and drink suitable to his station in life as a pupil or apprentice to a Surgeon and medicines and attendance in case of sickness

And further that if the said Charles Mends Gibson shall depart this life before the expiration of the said term leaving the said pupil or apprentice him surviving then and in that case the Executors or administrators of the said Charles Mends Gibson shall and will return and pay or remit or abate to the said John Wright Clover his Executors or Administrators within three Calendar months next after the decease of the said Charles Mends Gibson such a sum of money out of or part of the said premium of Two hundred and forty pounds as shall in the opinion of two disinterested persons one to be chosen by the Executors or Administrators of the said Charles Mends Gibson and the other by the said John Wright Clover his Executors or Administrators or of an Umpire to be chosen by such two persons in the usual way be considered a fair and equitable equivalent for the loss of service and instruction which the said pupil or apprentice shall or may sustain by the death of the said Charles Mends Gibson or otherwise that the said pupil or apprentice and these presents shall be assigned by the Executors or Administrators of the said Charles Mends Gibson to some fit and competent person to the satisfaction of and free of any expense to the said John Wright Clover his Executors or Administrators

And the said John Wright Clover for himself his Heirs Executors and Administrators doth hereby covenant promise and agree to and with the said Charles Mends Gibson his Executors and Administrators that he the said John Wright Clover his Executors or administrators shall and will on the eighteenth day of September One thousand eight hundred and forty two well and truly pay or cause to be paid unto the said Charles Mends Gibson, in case he shall be then living, the sum of Eighty pounds part of the said premium and on the eighteenth day of September One thousand eight hundred and forty three will also pay or cause to be paid to the said Charles Mends Gibson, in case he shall then be living, the further sum of Eighty pounds being the residue of the said premium or sum of Two hundred and forty pounds

And also that he the said Joseph Thomas Clover shall not at any time during the said term destroy waste embezzle spend or make away with any of the Instruments Drugs monies or other property of the said Charles Mends Gibson his Executors Administrators or Assigns which shall be deposited in his hands or entrusted to his care custody or possession or see it to be done by others without acquainting the said Charles Mends Gibson of the same Nor shall he disclose any of the secrets which may belong to the said Charles Mends Gibson his profession or business Nor disobey the lawful commands of the said Charles Mends Gibson Nor shall he depart or absent himself from the service or employ of the said Charles Mends Gibson at any time during the said term without his consent first obtained but in all things as a diligent pupil and faithful Apprentice he shall behave himself towards the said Charles Mends Gibson his family and patients during the said term

And further that he the said John Wright Clover his Executors or Administrators shall and will during all the said term fund and provide the said Joseph Thomas Clover with suitable and sufficient wearing apparel and clothing washing, Surgical and other Instruments and Books usual and necessary for a Medical Student, pocket money and all other necessaries not hereinbefore covenanted to be found and provided by the said Charles Mends Gibson his Executors or Administrators

And also shall and will from and after the eighteenth day of September One thousand eight hundred and forty four for the then residue of the said term find and provide the said Joseph Thomas Clover with sufficient meat and drink and convenient Lodging and with medicine and medical attendances in case of sickness

In Witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first within written
